2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 504, 506, 307, 379/34 of the Indian Penal Code and Section 27 of Arms Act.
3. Allegation against the petitioner along co-accused persons is that they committed theft in the grocery store of the informant due to which she suffered a loss of Rs. 2 lacs. I is further alleged that they made firing but did not hit anyone and also they gave criminal intimidation to the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The
Patna High Court CR. MISC. No.44535 of 2024(2) dt.02-07-2024 2/2 petitioner is not named in the FIR. He has falsely been implicated in this case due to long existing dispute. It is further submitted that the petitioner has got no criminal antecedent and he is languishing in judicial custody since 16.4.2024. Moreover, similarly situated co-accused Ramesh Singh has already been enlarged on bail granted by this Court vide order dated 24.4.2023 passed in Cr. Misc. No. 11824 of 2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Nowkothi P.S. Case No. 134 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Begusarai.
