JUSTICE SUDHIR SINGH ORAL ORDER 13-07-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 147, 342, 324 and 302 of the Indian Penal Code.

Allegation against the petitioner is that he along with other accused persons surrounded informant and others and assaulted them. The death of the victim Basaki Singh caused due to assault made by other accused persons.

It is submitted on behalf of the petitioner that he has got no criminal antecedent. The main allegation is against co-accused, namely, Pudina Yadav, Pappu Yadav and Dinesh Sao, who have assaulted the deceased with tangi upon his head, left hand and chest respectively. So far as petitioner is concerned, no specific injury is attributed against him. As per allegation, petitioner is said to have assaulted Bhutari Choudhary but there is no injury report to support the allegation made in the F.I.R. The other coaccused has been granted anticipatory bail vide Cr. Misc. no. 3224 of 2016.

On behalf of the State, it is submitted that petitioner is

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Khaira P.S. Case no. 183 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) sudip/- U T
