Mr.Navin Kumar Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 22-01-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

Petitioner is husband of opposite party No.2. Allegation is of demand of dowry and torture for the same. The matter was placed before the Patna High Court Medication Committee and learned counsel for the petitioner informs that since the petitioner was ready for one time settlement and

Patna High Court CR. MISC. No.43812 of 2019(4) dt.22-01-2020 2/2 separation but the wife did not agree. Hence, settlement failed. Further informs that divorce case has also been filed by the petitioner.

Considering the nature of allegation and material available on the record, I am not inclined to enlarge the petitioner on anticipatory bail. Hence, prayer is refused in connection with Complaint Case No.1552 of 2017 corresponding to Trial No.3819 of 2018 pending in the court of learned S.D.J.M., Darbhanga.

However, prayer for regular bail shall be considered without being prejudiced by this order. (Birendra Kumar, J) Nitesh/- U T
