The case was registered several years ago against the petitioner and another co accused by the informant alleging that the two acquaintances of the informant took the motorcycle of the informant but failed to return even after requests. Subsequently one of the co accuseds who appeared before the Court was exonerated of the charge on the basis of the compromise entered between the informant and the co-accused, namely, Raj Kumar Singh. The order passed by the Court has been enclosed It is submitted that the petitioner was not aware of the case and as such he could not appear earlier. The petitioner undertakes to appear before the Court on every date if granted the privilege of anticipatory bail. He has no criminal antecedent. In the facts and circumstances of the case, this
Patna High Court Cr.Misc. No.49218 of 2015 (2) dt.05-11-2015 2/2 Court is inclined to extend the privilege of anticipatory bail to the petitioner. Let the petitioner, named above, in the event of his arrest/surrender before the learned Court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar, in connection with Katihar (Town) P.S. case no.130 of 1999, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. with further following conditions:- (i) One of the bailors shall be the own/close family member of the petitioner.
(ii) The petitioner shall appear in person before the trial court on the date(s) fixed at the trial. In case of default in such appearance on two consecutive dates, the trial Court shall have liberty to cancel the bail bonds of the petitioner and secure his arrest in accordance with law.
