JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-09-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State. Despite valid service of notice, nobody appears on behalf of opposite party no. 2.

2. The petitioner apprehends her arrest in a case registered for the offence punishable under Sections 406, 420, 467, 468, 471 of the Indian Penal Code.

It is alleged that co-accused Shambhu Prasad, who is Director of Dumraon Commercial Credit Finance Company, and Maya Devi (petitioner), being Joint Director of the Company induced the informant/opposite party no. 2 to deposit money in their company with an assurance that his money would be doubled after two years and therefore, the informant deposited Rs. 17100/- in the company of the accused persons, but the informant neither got the maturity amount nor his actual money. It is further alleged that the accused persons

4. Learned counsel for the petitioner submits that dispute has been resolved between the parties. The petitioner, after knowing the fact of filing of present case, contacted the opposite party no. 2 and thereafter, paid the entire dues. To this effect, a compromise petitioner has already been filed in the Court below, vide Annexure - 3 to the petition. Petitioner is lady and claims clean antecedent.

5. Considering the fact that dispute has already been settled between the parties and petitioner is lady, having clean antecedent, in the event of arrest or surrender within a period of eight weeks from today, let this petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Buxar in connection with Dumrao P.S. Case No. 27 of 2003, subject to the conditions, as laid down under Section 438(2) of the Code of Criminal Procedure.
