JUSTICE RAMESH KUMAR DATTA ORAL ORDER 05-11-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner prays for anticipatory bail in a case under Sections 366A and 34 of the Indian Penal Code. It is submitted by learned counsel for the petitioner that in the statement of the girl recorded under Section 164 Cr.P.C. the petitioner has not at all been named and it is only in the FIR that the petitioner is stated to have participated in taking the girl to the bus stop along with co-accused Chaudhary Prasad and Rita Devi. It is further submitted that both Chaudhary Prasad and Rita Devi have been granted anticipatory bail by this Court by order dated 30.7.2015 passed in Cr. Misc. No. 25920/2015.

No.46315 of 2015 (2) dt.05-11-2015 2/2 On a consideration of the facts and circumstances of the case and considering the aforesaid order dated 30.7.2015 of this Court, it is directed that the petitioner, Ram Swaroop Bhuiyan, in the event of his arrest/surrender in the court below within four weeks from today shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Imamganj P.S. Case No. 22/2015 to the satisfaction of the Additional Chief Judicial Magistrate, Sherghati, District Gaya, subject to the other conditions laid down under Section 438(2) Cr.P.C.
