The petitioner apprehends his arrest in Minapur P.S. Case No. 10/2016, registered for the offences punishable under Sections 379 and 34 of the Indian Penal Code. Petitioner is not named in the F.I.R. The informant alleged that two persons came on motorcycle. The motorcycle rider snatched his mobile and fled away, but the motorcycle fell down in a ditch thereafter the accused persons fled away leaving that motorcycle.
During the course of investigation, it appears that Pintu Kumar is the owner of the motorcycle and he disclosed that Chandan Kumar has kept the snatched mobile. The petitioner Vishal Kumar is alleged to be one of his associates.
Patna High Court Cr.Misc. No.31424 of 2016 (3) dt.23-09-2016 2/2 It appears that the informant has stated that only two persons was on motorcycle at the time of snatching the mobile, but the owner of the motor-cycle disclosed that petitioner was also one of his accomplices.
Considering the facts aforesaid and the fact that no other material is collected during the course of investigation to show the involvement of the petitioner, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No. 10/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
