The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 387 and other sections of the Indian Penal Code and section 27 of the Arms Act.
As per the prosecution case, the accused persons are said to have caught hold of the husband of the informant and coaccused Mantu Yadav shot him as a result of which he died. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. From perusal of the F.I.R., it would transpire that the allegation of overt act is against Mantu Yadav. The said Mantu Yadav has
Patna High Court CR. MISC. No.53178 of 2021(2) dt.12-01-2022 2/2 been enlarged on bail vide order dated 6.3.2020 passed in Cr. Misc. no.73600 of 2019. The petitioner is in custody since 18.3.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with grant of bail to the co-accused Mantu Yadav and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Sessions Trial no.235 of 2019 (arising out of Parbatta P.S. Case no.128 of 2019) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge V, Khagaria.
