29-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Nayagaon P.S. Case No. 61 of 2020, registered for the offence under Sections 147, 148, 149, 386, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, the F.I.R. named accused persons fired at the informant, however; no injury was caused to him.

It is submitted on behalf of petitioner that though, petitioner is named in the F.I.R., but no specific allegation of firing is against him. It is further submitted that similarly situated co-accused Ram Binod Singh has already been granted bail by the court below itself (Annexure - 2), whereas, coaccused Gulshan Kumar has been granted bail by a coordinate

Patna High Court CR. MISC. No.51679 of 2021(2) dt.29-11-2021 2/2 Bench of this Court, vide order dated 22.11.2021 passed in Cr.Misc. No. 21254 of 2021. Petitioner has got clean antecedent and he is in custody since 15.03.2021. Chargesheet has been submitted.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Begusarai in connection with Nayagaon P.S. Case No. 61 of 2020.
