ANJANA MISHRA ORAL ORDER 22-11-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Aurangabad(M) P.S. Case No.50 of 2015 for allegedly having committed the offences under Sections 419, 420 of the Indian Penal Code and Section 10 of the Bihar Conduct of Examination Act, 1981.

It is submitted on behalf of the petitioners that the petitioners had earlier executed bond under Section 437 of the Cr.P.C. before the police and never misused such privilege. They are also willing to appear in the court below after submission of the chargesheet.

No.32641 of 2016 (2) dt.22-11-2016 2/2 In view of the aforementioned facts and circumstances and also because they have also not misused the privilege of police bail, let both the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of `10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad(M) P.S. Case No.50 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
