JUSTICE SANJAY PRIYA ORAL ORDER 28-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Pipra P.S. Case No. 60 of 2016 initially, instituted for the offence under Sections-363 and 365 of the Indian Penal Code and later on, Section-302/34 of the Indian Penal Code was also added.

It has been submitted on behalf of the petitioner that she is Bua of the informant. Mere suspicion has been raised against her. Her name has been disclosed by Ashok Choudhary in his confessional statement.

In the written report, it is alleged that mother of the informant was taken by this petitioner to her house and in the morning, when his mother did not come back, the informant went to inquire about her but this petitioner fled away after seeing the

Patna High Court Cr.Misc. No.35458 of 2017 (4) dt.28-08-2017 informant. It is alleged that Phupha of the informant namely, Ram Babu Choudhary threatened the informant. It is further alleged that relation of father and mother of the informant was not good and the informant has suspicion that his father, Ashok Choudhary, Bua and Fufa namely Sheo Muni Devi (petitioner) and Rambabu Choudhary confined his mother.

The C.D. has been received.

The learned APP after looking into C.D. has submitted that name of this petitioner was disclosed in confessional statement of Ashok Choudhary. Besides this, there is no other specific allegation against this petitioner.

In such circumstances, prayer for bail is allowed. The petitioners named above are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Pipra P.S. Case No. 60 of 2016 corresponding to Sessions Trial No. 334 of 2017 to the satisfaction of learned Additional Sessions Judge-X, Patna subject to condition that both the bailors should be close relative of the petitioner.
