ANJANA MISHRA ORAL ORDER 04-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State assisted by the informant.

The petitioner is apprehending his arrest in Narhat (Sitamarhi) P.S.Case No.60 of 2016 for the offences under Sections 147, 148, 149, 302, 337, 171 (C), 188, 504 of the I.P.C. and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that though his name has surfaced in the F.I.R., there is specific allegation of firing against one Manish Kumar who is said to have fired at deceased who died, instantaneously. It is further submitted that the petitioner has also fired at random, which is not said to have hit any one during the occurrence. The allegation appear to

Considering the nature of allegation made and that no specific role has been assigned to the petitioner and also because he has got no any criminal antecedent, let the petitioner, above named, in the event of his arrest/ surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-3rd, Nawada, in Narhat (Sitamarhi) P.S. Case No.60 of 2016 subject to the conditions as laid down under Section 438 (2) of Cr.P.C.
