Petitioner prays for bail in connection with Nawanagar (Basudeva) P.S.Case No. 86 of 2018 registered for the offences punishable under Sections 307/34 of the Indian Penal Code and 27 of the Arms Act.

Petitioner against the petitioner is of firing and causing injury on the hand of informant.

Submission of learned counsel for the petitioner is that whole case is false and concocted and occurrence took place on 31.5.2018, whereas X-ray place shows the date as 11.6.2018 and petitioner has falsely been implicated in this case because of the fact that petitioner has been selected in Army and due to that he has been implicated in this case.

Patna High Court Cr.Misc. No.47736 of 2018 (3) dt.20-09-2018 2/2 Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail stating that injury is grievous in nature.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar, in connection with Nawanagar (Basudeva) P.S.Case No. 86 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
