This is an application for bail in connection with Sachivalay P.S.Case No. 05 of 2017 registered for the offences punishable under Sections 363, 365/34, 302 and 201 of the Indian Penal Code.
Petitioners are named in the FIR and there is allegation that they got the deceased killed.
Submission of learned counsel for the petitioners is that whole prosecution case is based on suspicion and there is no eyewitness to the occurrence and there is allegation that there was relationship between petitioner No.1 and deceased and he was disclosing this to other persons, as such, they got the deceased killed. Further submission is that father of petitioner No.1 has already been granted bail by a co-ordinate Bench of this Court in
Patna High Court Cr.Misc. No.47967 of 2017 (3) dt.15-11-2017 2/2 Cr.Misc.No. 34453 of 2017, vide order dated 31.8.2017 and petitioners are in custody for nine months.

Having heard both sides and in view of facts and circumstances, as stated above, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-cum-Sub Judge, Patna, in connection with Sachivalay P.S.Case No. 05 of 2017, subject to the following conditions : (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioners shall co-operate in trial and appear on each and every date in court, failing which their bail bonds shall be cancelled.
