The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 47(a)(c) of Bihar Excise (Amendment) Act, 2016.
Allegation against the petitioner is that from the house of the petitioner Shankar Choudhary, six litres of Mahwa wine was recovered, contained in a white jar.
Learned counsel for the petitioner squarely denied the same and submits that the said recoveries were not made from his conscious possession and that the seizure-list does not contain his signature.
Considering the aforementioned facts and circumstances,
Patna High Court Cr.Misc. No.30473 of 2016 (2) dt.17-08-2016 P2/2 let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with Govindpur P.S. Case No. 28/2016 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
