Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Kaluahi P.S. Case No. 75 of 2017, (C.R.I. No. 1050 of 2017) corresponding to S.T. No. 165 of 2018 registered for the offence under Sections 304 (B)/34 of the IPC.

As per allegation in the FIR, the petitioner along with the other accused persons killed the niece of the informant due to non-fulfillment of demand of dowry.

Earlier, the bail petition of the petitioner was rejected twice in Cr. Misc. No. 20200 of 2018 and Cr. Misc. No. 24771

Patna High Court CR. MISC. No.52479 of 2021(3) dt.31-03-2022 2/2 of 2019, vide order dated 04.05.2018 and 15.05.2019 respectively.

Vide order dated 06.01.2022, report was called for with regard to the present stage of trial. In reply thereof, report dated 22.01.2022 would reveal that out of eleven witnesses, the prosecution examined 10 witnesses till 12.01.2022 and only the I.O. of this case is required to be examined. Considering the fact and circumstances of the case, I am not inclined to enlarge the petitioner on regular bail, however, learned trial court is directed to expedite the trial and conclude the same.
