JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-09-2017 The petitioner seeks regular bail in connection with Asthawan P.S. Case No. 135 of 2017, registered for offences punishable under Sections 30(a)(g) the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of more than 280 litres of country made liquor.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and other co-accused having similar allegation has already been granted bail vide order dated 10.08.2017 passed in Cr. Misc. No. 36021 of 2017 and vide order dated 25.08.2017, Cr. Misc. No. 36972 of 2017 and petitioner has been in judicial custody since 30.06.2017. Learned counsel for the State opposed the prayer for bail

Patna High Court Cr.Misc. No.42627 of 2017 (2) dt.14-09-2017 and submitted that petitioner has criminal antecedent as he is an accused in one more case of similar nature as the present one. Having heard both sides, considering the facts and circumstances of the case and also that other co-accused persons have already been granted bail by coordinate Benches of this Court, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - VI-cum Special Judge, (Excise) Nalanda at Biharsharif, in connection with Asthawan P.S. Case No. 135 of 2017.

It is made clear that if the petitioner again found involved in any of the like offences, in future, prosecution will be free to move for cancellation of his bail bonds.
