JUSTICE RAKESH KUMAR ORAL ORDER 07-01-2015 Learned counsel for the petitioner, after some argument, in presence of Sri R.R.K. Pandey, learned SC No. 29, submits that of-course in compliance with the order of the writ court the claim of petitioner has been rejected by Principal Secretary vide Annexure - 'A' to the show cause filed on behalf of opposite party no. 1, 2 and 3, there are apparent errors in the said order, and as such, a prayer is being made for setting aside the order of Principal Secretary.
The court is of the opinion that in contempt jurisdiction it would be difficult for this court to adjudicate on correctness of
Patna High Court MJC No.1642 of 2014 (3) dt.07-01-2015 2/2 the order i.e. Annexure - 'A' to the show cause. Accordingly, there is no need to keep the matter pending.
The petition stands disposed of with an indication that if the petitioner feels aggrieved with Annexure - 'A' to the show cause i.e. order passed by Principal Secretary, the petitioner would be at liberty to assail the same in appropriate proceeding. The petition stands disposed of.
