JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 26-10-2016 The wife of the prisoner who died while being treated of his ailment has filed the present writ application to command the respondents to make payment of the compensation to the petitioner for the death of her husband due to negligence on the part of the State respondents.
A counter affidavit on behalf of the State respondent is filed disputing the aforesaid contention. It is stated that the prisoner was examined by the Jail doctor and referred to the District Hospital and thereafter to the Patna Medical College and Hospital. He was subsequently admitted in the Indira Gandhi Institute of Cardiology where he died in course of treatment.
Patna High Court CWJC No.7064 of 2014 (3) dt.26-10-2016 Considering the above, it would be difficult for the Court to adjudicate on the grievance of the petitioner. Mr. Behzad Akhtar, the counsel for the petitioner, after making submissions at some length, states that the petitioner would ventilate her grievance before the Human Right Commission or before the appropriate forum in accordance with law.
