ANJANA MISHRA ORAL ORDER 16-08-2017 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in Maner P.S. Case No.457/16 for the offences under Sections 341, 323, 324, 307,379, 504 and 504/34 of the I.P.C.

Learned counsel for the submits that though there is specific allegation against the petitioner is that he gave a saif blow causing cut injury on the head of the daughter of the informant, namely, Nisha Kumari, but she has not named the present petitioner in her statement recorded under Section 164 Cr.P.C. Further more injury inflicted by the petitioner has been found to be simple in nature. It is further submitted that there is case and counter case and both the parties are agnates. Considering the aforesaid facts and circumstances and

No.35714 of 2017 (2) dt.16-08-2017 2/2 there is history of the dispute between the parties and the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M.-VI, Danapur, Patna, in Maner P.S. Case No.457/16 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
