From the perusal of the merit list, it appears that both, the petitioner and the private respondent No. 6 sailed on the same boat so far as their qualification was concerned. Both of them are graduates but the petitioner has higher marks.

The requirement under the Bihar Targeted

Patna High Court CWJC No.13916 of 2019(2) dt.16-01-2020 2/2 Public Distribution System (Control) Order, 2016 is that an applicant with higher qualification has to be considered. In case of similarity in the qualification standard, primacy will be given to computer literacy and age.

The private respondent No. 6 is older in age to the petitioner. Considering this, the private respondent No. 6 has been selected.

This Court finds no anomaly in selection of private respondent No. 6 for being granted the PDS license.

The writ petition has no merits and is therefore dismissed.
