The petitioners seek bail in connection with Bhabhua P.S. Case No. 276 of 2020 registered for the offences punishable

Patna High Court CR. MISC. No.39943 of 2020(3) dt.23-03-2021 2/3 under Sections 419/420 of the Indian Penal Code and Sections 66(c), 66(d) of I.T. Act.

As per the prosecution case, money of informant has been withdrawn illegally from his account without his knowledge.

Learned counsel for the petitioners submits that similarly situated co-accused has been granted bail by this Hon'ble Court vide order dated 19.03.2021 passed in Cr. Misc. No.39902 of 2020. Petitioners are in jail custody since 26.06.2019.

Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, let the above named petitioners be enlarged on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) each only with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhabhua (Kaimur) in connection with Bhabhua P.S. Case No. 276 of 2020, subject to the following conditions :

(1) One of the bairlors will be their own blood relative, preferably, father, mother, brother, sister and/or his wife.

(2) The petitioners shall not indulge himself in any similar offence till conclusion of the trial.

(3) The petitioners shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, their bail bonds shall be liable to be cancelled by the learned court concerned.

(4) The petitioners shall co-operate with the investigation, if not already concluded and make themselves available and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail. (Anjani Kumar Sharan, J) Nasimul/- U T
