The petitioner seeks bail in connection with Nadi P.S. Case No. 105 of 2024 instituted for the offence under Sections 341 & 342 of the Indian Penal Code and Sections 8 & 12 of the POCSO Act.

As per prosecution case, allegation against the petitioner is of sexually assaulting the minor daughter of the informant.

It has been submitted on behalf of the petitioner
Patna High Court CR. MISC. No.47936 of 2024(5) dt.10-12-2024 2/3 that the petitioner is in custody since 01-04-2024. Petitioner is a man of clean antecedent.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. It is submitted that petitioner is old aged man of 71 years and he is living with his family having good moral conduct. There is no independent witness to the occurrence. It is submitted that the present case has been instituted with a view to teach lesson to the petitioner being owner of the house due to petty dispute of demand of rent.

Learned A.P.P. for the State and learned counsel for the Informant have vehemently opposed the prayer for grant of bail to the petitioner. Other witnesses have also supported the prosecution case.

A report was called for from the trial court and it is reported that all charge sheet witnesses including the victim have been examined and case is fixed for statement of accused under Section 313 of the Cr.P.C.

Considering the aforesaid facts and circumstances of the case, nature and gravity of the offence and specifically taking into account the fact that trial is on the verge of its conclusion, this Court, at this stage, is not inclined to grant bail
Patna High Court CR. MISC. No.47936 of 2024(5) dt.10-12-2024 3/3 to the petitioner. Prayer is accordingly rejected. 9.
The Trial Court is directed to expedite the trial as expeditiously as possible without any undue delay and unnecessary adjournments.
