ANJANA MISHRA ORAL ORDER 11-03-2015 Heard learned counsel for the petitioner and the learned counsel for the State.
The petitioner is apprehending his arrest in connection with Siwan Mahila P.S. Case No.26 of 2013 for allegedly having committed the offences under Sections 341, 323, 406 and 498A of the Indian Penal Code.
The petitioner is the husband of opposite party No.2, who had earlier been issued notices in the present case. However, despite receipt of notice, she has chosen not to appear before this Court.
Considering the fact that there is general and omnibus allegation under Section 498A of the Indian Penal
Patna High Court Cr.Misc. No.52324 of 2013 (5) dt.11-03-2015 2/2 Code against all the family members by the wife of the petitioner (opposite party No.2), let the above named petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan, in connection with Siwan Mahila P.S. Case No.26 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
