Case No. 110 of 2013 instituted under section 379 of the Indian Penal Code later on section 411 was also added.

Learned counsel draws attention to this court to the order of the learned Sessions Judge shows that one Md. Imran was arrested with stolen motorcycle and allegedly in his confessional statement to the police he has named the petitioner as the person to whom the motorcycle was to be delivered. It is submitted that the petitioner has neither stolen the motorcycle nor was in receipt thereof.

Be that as it may, let the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks be released on bail on furnishing
