The petitioner, being the husband of the complainant is apprehending arrest in a case registered under Sections 498A of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act. The basic accusation is of torture for non-fulfillment of dowry demands.
On instruction, it is submitted that the petitioner admits his marriage with the complainant and is ready to keep the complainant as wife with full dignity and honour. Statement to the aforesaid effect has been made in paragraph no. 10 of the petition, which reads as follows :
"That, it is stated and humbly submitted that the petitioner being husband of the complainant is ready to lead happy conjugal life with her."
It is, further, submitted that similar stand was taken before the Court below, but, the learned single Judge disposed off the application with a direction to the petitioner to surrender and
Patna High Court Cr.Misc. No.36866 of 2016 (2) dt.24-08-2016 seek the regular bail and settle the dispute with the complainant. Considering the present stand of the petitioner, above named, he be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Complaint Case No. 68 of 2014, Tr. No. 2266 of 2014 to the satisfaction of the Subdivisional Judicial Magistrate, Aurangabad.
