JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 718 of 2017, instituted for the offences punishable under Sections 406 and 420 of the Indian Penal Code pending in the court of Chief Judicial Magistrate, Gopalganj.

Allegation against the petitioner is that on the pretext of providing job he has taken Rs.90,000/- and produced forged and fabricated documents.

Submission of learned counsel for the petitioner is that there is no chit of paper to show that he has taken money and considering the same, other co-accused persons have been granted anticipatory bail by a co-ordinate Bench of this Court

Patna High Court CR. MISC. No.44619 of 2019(2) dt.19-07-2019 2/2 vide order dated 4.12.2018 passed in Cr.Misc.No. 72091 of 2018.

Heard learned APP also.

In view of above facts and circumstances and considering the fact that case of the petitioner is not similar to the other co-accused, I am not inclined to grant the privilege of anticipatory bail to the petitioner.

With the above observation, this application is dismissed.
