Explanation is accepted with warning to the learned trial Judge to be careful in future while sending report to this Court.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with S.T. No.330 of 2012, arising out of Tariyani P.S. Case No.56 of 2010, a case under Sections 307/326/324/341/147/379/504/34 of the Indian Penal Code.

Petitioner is in custody since 19.12.2016.

Allegation against the petitioner is of commission of injury with

Patna High Court Cr.Misc. No.49104 of 2017 (6) dt.10-01-2018 P2/ acid on the person of Hira Kumari. The report of the learned trial Judge reveals that though charges have been framed but trial is not proceeding.

Earlier prayer for bail was refused on 12.04.2017 in Cr. Misc. No.11262 of 2017 with direction to the learned trial judge to expedite the trial.

Considering the entire facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
