JUSTICE ALOK KUMAR SINHA ORAL ORDER 08-07-2026 Heard learned counsel for the petitioner, learned counsel for the respondent-Bhupendra Narayan Mandal University and learned counsel for the respondent-State.

2. With the consent of the parties, this writ application is being disposed of at this stage itself.

3. In the present writ application, the petitioner has prayed for the grant of following reliefs:

"(i) For issuance of an

2/4 appropriate writ or writs in the nature of writ of mandamus to command the Respondent State Authorities to release the required amount and to pay the amount of difference of salary i.e. from July 1998 to December 2015 amounting to Rs.40,71,230/- in view of letter No. A/c 132/24 dated 30.11.2024 of the respondent no. 6 forwarded to the respondent nos. 3 & 4 which is due to the Petitioner alongwith statutory interest with all consequential benefits and for further direction/directions, relief/ reliefs in the facts and circumstances of the case the petitioner may entitled too."

4. Learned counsel for the petitioner submits that the Principal of the College vide letter no. A/C 132/24 dated 30.11.2024 calculated arrears of difference of salary with respect to 23 teachers of the College (retired and expired teachers which includes the petitioner) and forwarded the same to the Registrar and Finance Officer of the respondentUniversity. The said letter has been brought on record by way of Annexure-P/2. The letter dated 30.11.2024 was sent to the Registrar and Finance Officer of the respondent-University along with calculation chart of arrears from the date of eligibility.

5. It is further submitted that despite the College having sent the calculation of arrears, till date, the respondentUniversity has not taken any decision and has not made payment to the petitioner. Thereafter, the petitioner has filed several representations before the Registrar of the respondentUniversity, the latest one being dated 04.04.2026 (AnnexureP/6) and the said representation continues to be pending till today. Learned counsel for the petitioner, therefore, prays that the petitioner would be satisfied if an appropriate direction be issued to the Registrar of the respondent-University to take a final decision on the representation filed by the petitioner for release of arrears of difference of salary which has been shown in the calculation chart which has been brought on record at page 38 of the writ application.

6. To the aforesaid prayer being made by learned counsel for the petitioner, learned counsel appearing for the respondent-State and respondent-University do not have any objection.

7. Considering the limited nature of prayer being made by learned counsel for the petitioner, this writ application is disposed of directing the Registrar of the respondentBhupendra Narayan Mandal University to take a final decision

4/4 on the pending representation of the petitioner dated 04.04.2026 (Annexure-P/6) within three months from the date of receipt/production of a copy of this order, after giving an opportunity of hearing to the petitioner. It is made clear that in case, the petitioner is found entitled to the arrears of difference of salary as is being claimed by the petitioner and the calculation of which has been shown in the chart, which has been brought on record at page 38 of the writ application, the same should be extended to the petitioner within a further period of two months from the date of disposal of the representation.

8. With the aforesaid observation/direction, this writ application is disposed of. All pending interlocutory application(s), if any, shall also be deemed to have been disposed of.
