01-09-2016 Heard Sri Rabindra Prasad Singh, learned counsel for the petitioner. None appeared on behalf of State. The petitioner, who is lady apprehending her arrest in Sare P.S. Case No. 46 of 2016 registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act, 1959, has prayed for grant of bail in the event of arrest or surrender.
It was submitted by learned counsel for the petitioner that on trivial issue, occurrence in between both sides had taken place. Accordingly, from the petitioner's side, son of the petitioner had lodged an F.I.R., which was registered as Sare P.S. Case No. 47 of 2016 for offence under Sections 341, 323, 504, 308/34 of the Indian Penal Code. He submits that in retaliation, entire family
Patna High Court Cr.Misc. No.34424 of 2016 (2) dt.01-09-2016 2/2 members have been implicated, including the petitioner, whereas, at the time of occurrence, the petitioner was not present. Be that as it may, since there was case and counter case in between the parties and petitioner being lady, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Radha Devi be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Sare P.S. Case No. 46 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
