====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 19-09-2017 Heard Mr. Farooque Afzal, learned counsel for the petitioner and Sri Nirmal Kumar Sinha, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 01.07.2017 in Buddha Colony P.S. Case no.212/2017, Spl. Case No.3216/17 registered for the offence under Sections 272/273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that the petitioner was having no concern but he was apprehended , as if the petitioner was fleeing away after noticing the police from XUV-500 vehicle. It has been argued that the petitioner was not having any connection with the recovery of Indian

Learned Addl. Public Prosecutor has opposed the prayer of the petitioner and submits that the petitioner is also accused in another similar nature of case.

Considering the nature of accusation and period of custody, let the petitioner, namely, Ram Murti Singh be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-VIII-cum- Spl. Judge, Excise, Patna in connection with Buddha Colony P.S. Case No.212/2017, Spl. Case no.3216/17. (Rakesh Kumar, J) nawalkrs/- U T
