The petitioner seeks bail in Alamganj P.S. Case No. 201/2018, instituted for the offences under Sections 379 and 411 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is not named in the F.I.R.

It is alleged in the written report that the informant had parked his motorcycle outside his house in lane and went in his house. When he returned back, his motorcycle was missing and in spite of search, the same could not be traced out. It is further alleged that during investigation search was made in the house of petitioner and one Chassis of Apache Motorcycle and other parts

Patna High Court Cr.Misc. No.50084 of 2018 (3) dt.01-10-2018 2/2 of Apache Motorcycle was recovered from his house. Thereafter the petitioner was arrested.

It is mentioned in the impugned order that in para 27 of case diary during investigation co-accused Shiv Samrat and Guddu have confessed that they had committed theft of alleged motorcycle and sold the same to petitioner.

The petitioner is in custody since 06.06.2018. He has clean antecedent.

Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Patna City, Patna in connection with Alamganj P.S. Case No. 201/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
