Petitioner apprehends his arrest in connection with Salimpur P.S.Case No.11 of 2014 pending in the Court of learned Judicial Magistrate, Barh, Patna registered under Sections 420, 409 and 120(B) of the IPC.

The earlier prayer for anticipatory bail of the petitioner was rejected vide order dated 08.05.2015 passed in Cr.Misc.No.40395 of 2014.

Learned counsel for the petitioner submits that the petitioner has already constructed the building. The police after

Patna High Court Cr.Misc. No.33190 of 2016 (3) dt.24-08-2016 investigation found that the building has already been constructed but it appears that the petitioner received Rs.10,22,000/- in the year 2008-09 and the petitioner kept the money meant for construction of the school building and when the case was lodged in the year 2014, the petitioner started constructing the building. The petitioner kept public money for years with him. Considering the facts aforesaid and the fact that prayer for anticipatory bail of the petitioner has already been rejected, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the same is rejected.
