2. The writ petitioner has approached this Court seeking a direction to promote him to the post of the Chief Manager (Scale V) which was denied to him since 2003-04. During pendency of the instant writ petition, the petitioner was granted promotion to the post of the Chief Manager (Scale V) vide Circular dated 8.12.2008. Another relevant fact to be noted is that as pending consideration of the writ petition, the petitioner retired

Patna High Court CWJC No.14811 of 2008 dt.22-03-2018 from service on 31.10.2016, learned counsel for the petitioner confines the prayer to the extent that the petitioner my be permitted to approach the Chairman cum Managing Director, New India Assurance Co. Limited (respondent no.1) claiming shifting of the date of his promotion to the post of the Chief Manager (Scale V) to the year 2006 in place of 2008 as it is his grievance that under the Revised Promotion Policy for officers of 2006, there was specific provision that the Promotion Committee will take into account regional imbalance for the purpose of suitably moderating the marks obtained by the competing candidates. Learned counsel further submits that the petitioner has not been given promotion even though he was the only candidate elegible from the Eastern Zone in the year of promotion 2006.

3. In view of the said limited prayer of the petitioner, the writ petition needs not be kept pending. The writ petitioner may approach respondent no.1 (Chairman cum Managing Director, New India Assurance Co. Limited) by filing a comprehensive representation with respect to his grievance which may be considered and disposed of by a reasoned and speaking order in accordance with law within a period of three months from the date of receipt/production of the representation along with a copy of this order.
