This is an application for bail in connection with Bibhutipur P.S. Case No. 72 of 2017 registered for the offences punishable under Sections 302 of the Indian Penal Code and 27 of the Arms Act.

Petitioner is named in the FIR and as per FIR there was hot exchange of words between the petitioner and informant and one Chinku Singh had fired which hit on daughter of informant and due to which she died.

Submission of learned counsel for the petitioner is that there is no allegation of firing against him and he is in custody for more than four months. Further submission is that he is made accused in one more case but he is on bail in that case. Heard learned APP also.

Having heard both sides and in view of the facts and

No.45184 of 2017 (3) dt.17-10-2017 2/2 circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Rosera, Samastipur, in connection with Bibhutipur P.S. Case No. 72 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties in the jurisdiction of court concerned, (2) Petitioner shall mark his attendance in local police station in first week of every month till conclusion of trial or at least for a period of one year, whichever is earlier, so that police may watch his conduct during that period, failing which his bail bond shall be cancelled.

Let a copy of this order be communicated to the Superintendent of Police, Samastipur for compliance of this order. (Vinod Kumar Sinha, J) spal/- U
