In this case, the petitioners are seeking anticipatory bail in connection with Bhagwanganj P.S. Case No.175 of 2018, registered for the offence punishable under Sections 30 (a) (c) (d), 37 (b) of the Bihar Prohibition and Excise Act, 2016. Allegation has been made that the police on secret information that in bush of Chakiya Pyne illegal liquor are being manufactured, reached there and after seeing the police party, the accused persons fled away and from there 100 liters of country made liquor has been recovered.
Looking to the quantity of liquor recovered, this
Patna High Court CR. MISC. No.41284 of 2019(2) dt.05-07-2019 2/2 Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected. However, if the petitioners surrender before the Court below within four weeks from today and pray for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
