Two petitioners, apprehending their arrest in connection with Kudhani P.S.
Case no.183/15, G.R.
No.1249/2015 registered for the offence under Sections 328, 304(B)/34 of the Indian Penal Code, have prayed for grant of anticipatory bail.
It was submitted by learned counsel for the petitioners that the petitioner no.1 is mother-in-law of the deceased and petitioner no.2 is elder brother of the husband of the deceased. She
Patna High Court Cr.Misc. No.47500 of 2015 (3) dt.29-01-2016 2/2 submits that of course, the allegation has been made against the petitioners but during investigation, the fact has come that at the relevant time petitioner no.1 was not at the place of occurrence , rather she was staying with his another son.
Be that as it may, keeping in view the allegation made in the F.I.R. the Court considers that it is not a fit case for extending the privilege of anticipatory bail. However, if the petitioners appear before the court below and make a prayer for regular bail within a period of six weeks from today, the Court expects that the learned court below may examine the same and pass appropriate order in accordance with law preferably on the same day.
The petition stands disposed of.
