Mr. Manoj Kumar No. 1, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-06-2021 Heard Mr. Indu Shekhar Dwivedi, the learned Advocate for the petitioner and Mr. Manoj Kumar No. 1, the learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Pali P.S. Case No. 21 of 2020, dated 07.03.2020, instituted for the offence under Section 30(A) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Regard being had to the fact that the petitioner has been made accused in a case of similar nature in the past, I am not inclined to grant him anticipatory bail. The prayer for grant of anticipatory bail of the

Patna High Court CR. MISC. No.39664 of 2020(2) dt.07-06-2021 2/2 petitioner is, accordingly, rejected.

However, if the petitioner surrenders before the Court below and seeks bail, the Court below, after taking into account and verifying the fact that the house from where the recovery has been made does not belong to the petitioner, shall pass orders in accordance with law, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court. The application stands dismissed.
