JUSTICE SANJAY PRIYA ORAL ORDER 27-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kurtha P.S. Case No. 195 of 2016 instituted for the offence under Sections 420, 467, 468, 471, 409 and 120B of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is in custody since 13.6.2018.

In the written report it is alleged that petitioner being Junior Engineer of Water Resources Department along with coaccused Sanjay Kumar, the then Mukhiya and Satyendra Kumar Singh, the then Panchayat Secretary of Pinjrawa Gram Panchayat withdrew the huge amount for payment showing the works under the schemes completed. On inquiry, it was found that the works were not completed under the Schemes.

No.53382 of 2018 (3) dt.27-09-2018 2/2 Counsel for the petitioner has pointed out Annexure-2 which is report of Block Development Officer, Kurtha, from which it appears that all the project was inquired and enquiry report of Junior Engineer was submitted which is available at running page-127 of the brief which shows that the works have been completed Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal, in connection with Kurtha P.S. Case No. 195 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
