JUSTICE SATYAVRAT VERMA ORAL ORDER 28-02-2022 Heard Mr. Yogesh Chandra Verma learned Sr. counsel for the petitioner and Mr. Ashok Kumar Singh learned A.P.P. for the State and Mr. Vikash Verma, learned counsel for the informant.

The petitioner seeks bail in connection with Kateya P.S. Case No. 177 of 2021 instituted for the offences under Sections 386, 387, 302, 120(B) and 34 of the Indian Penal Code read with section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 03.06.2021, charge sheet has been submitted and has antecedent of one case and the petitioner is not alleged to be the assailant of the deceased. At this stage, learned Sr. counsel for the petitioner

Patna High Court CR. MISC. No.51925 of 2021(3) dt.28-02-2022 2/2 seeks permission to withdraw the present bail application. Permission is accorded with liberty to the petitioner to renew his prayer for bail after framing of charge. Accordingly, the application is dismissed as withdrawn.
