The petitioner apprehends his arrest in connection with Bodhgaya P.S. Case No. 68 of 2021 registered under Section 307 and other allied sections of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Nothing has been recovered from the conscious possession of this petitioner. Further he submits that from perusal of seizure list, it is evident that the alleged recovery has been made from co-accused Shanker Sao.
Petitioner has no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the
Patna High Court CR. MISC. No.52422 of 2021(2) dt.08-04-2022 2/2 event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Additional Sessions Judge-IIcum-Special Judge, Excise Act, Gaya in connection with Bodhgaya P.S. Case No. 68 of 2021 (Spl. Ex-421 of 2021) subject to the condition as laid down under Section 438(2) of the Cr. P.C.
