KUMAR ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner, who is in custody, seeks regular bail in connection with Jalalgarh Police Station Case No. 86 of 2017 registered for the offence punishable under Sections 363, 366(A), 504 and 506/34 of the Indian Penal Code.
The allegation against the petitioner is of kidnapping the minor daughter of the informant.
Learned counsel for the petitioner submits that the daughter of the informant herself had appeared before the court and her statement was recorded under Section 164 of Cr.P.C. in which she has stated that she had gone with petitioner as per her own volition and sweet will and thereafter they have solemnized
Patna High Court Cr.Misc. No.49087 of 2017 (2) dt.18-10-2017 marriage and she wants to live with his husband. The court has assessed the age of girl is 18 years, even informant has given age of her daughter as 17 years. It has further been submitted that he has got no criminal antecedent and he is in custody since 23.07.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Purnea, in connection with Jalalgarh P.S. Case No. 86 of 2017.
