JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-08-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Kudra P.S. Case No. 69 of 2017, registered for the offence punishable under Section 379 of the I.P.C.

The FIR is said to have been filed against one Pradip Kumar who had run away with the car of the informant after deceiving the driver of the informant. The name of the petitioner appears to have cropped up during investigation upon confession made by one Pradip Kumar.

Learned counsel for the petitioner submits that the petitioner has clean antecedent and only on the basis of suspicion the petitioner has been implicated in this case. She further submits that the petitioner has got no role to play in the alleged incident specially on the ground that no recovery has been made from his possession and is in custody since 11.06.2017.

Patna High Court Cr.Misc. No.39333 of 2017 (2) dt.19-08-2017 2/2 Having regard to the facts and circumstances of the case, I find that this is a fit case in which the petitioner should be released on bail.

Accordingly, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Kaimur at Bhabhua in connection with Kudra P.S. Case No. 69 of 2017.
