1. Heard learned counsel for the petitioner and learned counsel for the State.

2. The petitioner apprehends his arrest in connection with Vaishali P.S. Case No. 37 of 2023 registered under Sections 25(1-b)A, 26/35 of the Arms Act.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that petitioner is not named in the first information report and nothing has been recovered from the conscious possession of the petitioner. It is also submitted that the motorcycle from where the alleged recovery has been made does not belong to the petitioner. The petitioner has got no criminal antecedent.

4. Having considered the facts and circumstances of

No.42952 of 2023(2) dt.04-08-2023 2/2 the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali P.S. Case No. 37 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
