JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-09-2017 The petitioner seeks regular bail in connection with Sugauli P.S. Case No. 191 of 2017, registered for offences punishable under Sections 420 and 414 of the Indian Penal Code. Prosecution case is that police on information raided a garage and recovered a stolen motorcycle and the persons apprehended on spot disclosed the name of the petitioner and others that they were engaged in sell of stolen motorcycles. It has been submitted on behalf of the petitioner that there is nothing available on record to show that the motorcycle, which was recovered was stolen one. Moreover, the petitioner has sufficiently been punished for the said offence as he has been in judicial custody for last three months.

No.41536 of 2017 (2) dt.08-09-2017 Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with the direction to the court below to release the petitioner to his own satisfaction once charge is framed in this case or after completion of five months of judicial custody of the petitioner, whichever is earlier.
