2 The petitioner has preferred this application for grant of regular bail in connection with Mahua PS Case No 689 of 2022 dated 01.11.2022 registered for the offence punishable under Sections 272, 273/34 of the IPC and Section 30 (a) of the Bihar Prohibition and Excise Act.

3 As per the prosecution case, 189 liters of country made liquor was recovered from the Tempo parked in front of the house of the petitioner.

4 Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has clean antecedent, as stated in paragraph

Patna High Court CR. MISC. No.42957 of 2023(2) dt.20-07-2023 2/2 3 of the bail petition. The petitioner is in custody in this case since 10.05.2023.

5 Learned APP has vehemently opposed the bail petition of the petitioner.

6 Considering the aforesaid facts and circumstances of the case, the period of custody as well as the nature of allegation against the petitioner, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Excise Court No I -cum- Additional Sessions Judge, Vaishali at Hajipur in Mahua PS Case No 689 of 2022 dated 01.11.2022. 7 This application stands allowed.
