2. The present modification application filed for modification of order dated 19.05.2026 passed in Cr. Misc. No. 33530 of 2026, pertaining to the first condition imposed by this Court at paragraph no. 6 to the extent that the petitioner be permitted either to furnish two solvent sureties of local resident or the close relative of the petitioner may be permitted to furnish documents pertaining to fix deposit by bank as surety before this Court.
3. The learned counsel for the petitioner submits that the petitioner, namely Rahul Kumar, though was granted bail vide order dated 19.05.2026 passed in Cr. Misc.
Patna High Court CR. MISC. No.42586 of 2026(3) dt.10-07-2026 2/3 No. 33530 of 2026, however, with condition no. 6 (i) in the said order requiring a close relative or a family member to stand as a surety, could not be complied, as the petitioner happens to be a sole child and both his father as well as grandfather are no more. It has further been submitted that instead of the direction for furnishing bail bonds, the petitioner may be permitted to furnish documents pertaining to fix deposit in the form of FDR as surety and in order to furnish the same, the period for submitting the bail bond may also be extended for a further period of four weeks. The learned counsel has also pointed out that on account of such condition, the petitioner has not been able to furnish the bail bond within time.
4. Considering the aforesaid submissions, this modification application is allowed, the order dated 19.05.2026 passed in Cr. Misc. No. 33530 of 2026 is modified to the extent that the condition no. 6 (i) of the order shall stand modified to the extent that the same may be read as "one of the bailors will be a relative, who shall furnish surety in the form of fix deposit receipts and the other shall be a local resident". Patna High Court CR. MISC. No.42586 of 2026(3) dt.10-07-2026 3/3 bail bond is hereby extended for a period of further four weeks.
