JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Lalganj P. S. Case No. 118 of 2014 registered under Sections 341, 323, 354, 379/34 of the Indian Penal Code.

It is contended that there is an ongoing land dispute between the petitioner and informant's family and an informatory petition bearing no. 3395 of 2013 had already been filed by the mother of the petitioner against the informant expressing apprehension of implication in false case. It is further contended that several villagers have also filed a public petition before the Officer-in-charge, Lalganj Police Station, Vaishaili stating therein that the instant case has been lodged by the informant with false

Patna High Court Cr.Misc. No.49378 of 2015 (2) dt.03-11-2015 2/2 allegation against the petitioner. It is also contended that coaccused Amarjit Kumar has already been granted anticipatory bail by the learned Sessions Judge, Vaishali at Hajipur. Learned counsel for the State has opposed the application of the petitioner filed under Section 438 of the Code of Criminal Procedure.

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within four weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in Lalganj P. S. Case No. 118 of 2014, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
