JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-09-2017 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks regular bail in connection with Pakaridayal PS case no. 15 of 2017 registered for the offences punishable under Sections 387, 120B of Indian Penal Code. The case of the prosecution is that the informant Vinay Prasad has stated in his written complaint that a sum of Rs. 30 lacs was demanded by way of extortion over mobile phone bearing no. 9431435686 and upon not making good the said amount, it was stated that incident would occur at the place of the informant similar to the one which has taken place at Jaiswal Trading Company. Thereafter, one Shiv Shanker Sharma had called and demanded money.
The learned counsel for the petitioner submits that the petitioner is not an F.I.R. named accused person and he has
Patna High Court Cr.Misc. No.45613 of 2017 (2) dt.20-09-2017 2/2 been implicated only on the basis of confessional statement of one co-accused Mrityunjay Thakur. It is further submitted that the three cases said to be pending against the petitioner are such cases where the petitioner has been remanded after being arrested in the present case. It is further submitted that the petitioner is languishing in jail since 06.05.2017.
Having regard to the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of 5th Addl. Chief Judicial Magistrate, Motihari at East Champaran in connection with Pakaridayal PS case no. 15 of 2017.
