The petitioner has invoked the writ jurisdiction of this Court making a grievance that amount of General Provident Fund has not been paid.
In the counter affidavit, stand of the State is that an amount of Rs.1,45,349/- was paid vide letter dated 16.02.2006. In the rejoinder, the petitioner has asserted that certain of the amount has not been paid.
Thus whether certain payments has not been made, as mentioned by the petitioner in the rejoinder affidavit, or not is the question of fact.
Therefore, the present writ petition is disposed of with a direction to the respondents to consider the rejoinder to the counter affidavit as representation and pass speaking order, if any amount is found payable, the same shall be paid to the
Patna High Court CWJC No.7532 of 2014 (3) dt.22-10-2016 2/2 petitioner.
